- Informational and Referral Services Only: The purpose of our Platform is to provide general health insurance information and to act as an independent digital lead-generation and referral service connecting consumers with licensed insurance agents, brokers, or carriers.
- Not an Insurance Carrier or Agency: We are not an insurance company, brokerage, or licensed insurance agent. We do not sell insurance policies, underwrite coverage, bind insurance, or provide official quotes directly.
2. User Consent and Information Sharing
- Voluntary Submission: By filling out forms, requesting quotes, or submitting your contact information on this Platform, you explicitly consent to share your personal information with us and our network of certified partners.
- Consent to Electronic Communications: By using the Platform, you consent to receive communications from us and our partners electronically, including via email, telephone calls, and text messages (SMS) using automated dialing systems, at the contact information you provided, even if your number is on a federal or state ‘Do Not Call’ registry. Consent is not a condition of purchasing any goods or services.

We do not guarantee that the Platform will be uninterrupted, timely, secure, or error-free, or that any information obtained through the Platform will be accurate or reliable.
7. Limitation of Liability
To the fullest extent permitted by law, Pathway, LLC, our directors, officers, employees, affiliates, agents, contractors, and suppliers shall not be liable for any direct, indirect, incidental, punitive, special, or consequential damages (including lost profits, lost data, or replacement costs) arising out of or related to your use of the Platform, your reliance on any information provided, or your interactions with third-party insurance agents.
8. Indemnification
You agree to indemnify, defend, and hold harmless Pathway, LLC, our parent company, affiliates, partners, officers, directors, agents, contractors, licensors, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Use or your violation of any law or the rights of a third-party.
9. Changes to Terms
We reserve the right to modify, amend, or update these Terms of Use at any time in our sole discretion. Any changes will be effective immediately upon posting the updated terms to the Platform. Your continued use of or access to the Platform following the posting of any changes constitutes your binding acceptance of those changes.
10. Governing Law
These Terms of Use and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.
